Director of SAE/Litigation Management

Job Summary

This role supervises attorneys, assigned Litigation Specialists, and other SAE personnel responsible for managing Suits Against the Exchanges (SAE). In addition to overseeing complex and high exposure litigation (e.g. managing suits in excess of $1M) also authorizes and/or approves payment of claims or grants trial authority in accordance with established limits. Responsible for direct communications with Line of Business (LOB) leaders and Senior Executives on evaluations and recommendations of litigated cases to ensure the most favorable outcome for the organization. Also accountable for maintaining consistent and effective communications with the Claims organization and LOB leaders relating to case strategy and litigation trends. Develops and recommends procedures concerning investigations, evaluations and dispositions in accordance with the terms of each insurance policy and in conformity with applicable laws, regulations, and established objectives, policies, practices, standards, and procedures. Prepares and presents to management recommendations involving all matters of public relations that have a bearing on Company policy. Oversees the selection, evaluations, compensation, transfer, and termination of assigned employees, in accordance with established p ersonnel policies and practices for the SAE Department. Determines overall training needs of individuals in assigned territories, and directs the planning, development, and recommendation of procedures concerning investigation, evaluation and disposition of claims.

 

Ideally, selected candidate would be located in Pacific Time Zone.

Essential Job Functions

  • Works closely with the Head of Claims Legal Services to oversee litigation managed by the SAE department.
  • Responsibilities include managing assigned personnel, conducting high level meetings with Senior Executives and Chief Claims Officer to discuss extra contractual exposures within SAE and consulting with other Claims directors or personnel to develop strategy for litigated issues.
  • In addition, also evaluates, plans, develops, and recommends standards, practices, and techniques for investigations, evaluations, and the disposition of SAE litigation.
  • Analyzes statistics on SAE litigated files and shares results with Claims LOBs to make recommendations on improving claims handling policies and procedures.
  • Also identifies Claims training needs and may facilitate training when necessary with the goal of educating the Claims organization on good faith claims handling and the prevention of extra-contractual exposure to the organization.
  • Extends final authority on all suits within the SAE department and supports all requests for authority to the LOB Executives/leadership and Chief Claims Officer.
  • Prepares reports on various high exposure and complex litigation and provides recommendations for resolution.
  • Responsible for monitoring and controlling legal spends to ensure the organization is managing litigation service fees appropriately.
  • Performs other duties as assigned.

Education Requirements

Bachelor's degree required, law school degree (Doctor of Jurisprudence) from a State Bar Association-accredited law school, and member in good standing of the State Bar in the state in which position is located.

Experience Requirements

Five to seven years experience evaluating and managing extra contractual claims exposure. Prefer at least five years prior experience as defense counsel on Bad Faith litigation, and/or 10 years with Farmers as an attorney, or comparable outside legal experience. Prior public speaking experience in both large and small group settings is required. Demonstrated conflict management experience with ability to function in adversarial or confrontational situations. Prior supervisory or management experience required.

Special Skill Requirement

Proven creative problem solving skills and demonstrated ability to make sound, thorough, independent judgment decisions required.

  • CO Only: The pay range for this job being performed in CO would be $130,400-$174,000.
